Health & Wealth: Deed of extrajudicial settlement of estate with special power of attorney

The  other week after our arrival in San Francisco, California from our Carnival Cruise in Cabo San Lucas and Ensenada, B.C. Mexico as penultimate celebration of our 50th Wedding Anniversary with our daughters, grandsons and son-in-law, I received voicemail messages from Elizabeth, an old MSS (Mobile Signing Services) client residing in Daly City, California.

When I called her back, Elizabeth informed me that they (with her two daughters) need our Mobile Signing Services for the signing and notarization  of the Deed of Extrajudicial Settlement of Estate with Special Power of Attorney for the sale of six parcels of land located in the Municipality of Ivisan, Province of Capiz in the Philippines she jointly owned with her late husband who died on March 2, 2015 at St. Anthony Hospital in Capiz City, Philippines.

After further conversation, Elizabeth informed me that as the surviving spouse and surviving children, they (with her two daughters) need to have the Deed of Extrajudicial Settlement of Estate with Special Power of Attorney be signed and notarized because her two daughters can’t go to the Philippines. With the Special Power of Attorney given to her by her two daughters, Elizabeth can have full power and authority to sell the six land parcels she jointly owned with her late husband.

To save on gas and mileage fees, I suggested that Elizabeth and her daughter (who is residing in South San Francisco, California) will come to our home office in San Francisco, California. On Monday, June 17, 2024, Elizabeth and her daughter came to my home office for the signing of the seven sets of documents. Then, I had them signed my Journal of Notarial Acts and put their right thumb marks. Because the other daughter residing in Vacaville, California can’t come to my home office in San Francisco, California, Elizabeth arranged for the signing of the documents in Vacaville, California the following day.

On Tuesday, June 18, 2024, I met the younger daughter of Elizabeth inside the Learning Center (her workplace) in Vacaville, California. After some preliminaries, I had the younger daughter signed the seven sets of documents. She also signed my Journal of Notarial Acts and put her right thumb marks.

After notarization, I drove to the Secretary of State Office, Notary Public Section in Sacramento, California on June 20, 2024 and submitted the notarized documents for apostille. With the Front Desk now opened, I was able to wait for the release of the apostilled documents on the same day and drove back to our home in San Francisco later in the afternoon.

The following day, Friday.  June 21, 2024, Elizabeth came to my home office in San Francisco, California and picked up the two sets of apostilled Deed of Extrajudicial Settlement of Estate with Special Power of Attorney and duplicate copies for Elizabeth and her two daughters.

“Maraming salamat sa inyong tulong Art. Madala kona itong apostilled documents sa pagbakasyonko sa Pilipinas next month. (Thank you for your help Art. I can now bring the apostilled documents in my vacation to the Philippines next month), said Elizabeth.
