As an accredited and commissioned Notary Public and founder of Mobile Signing Services (MSS), I’ve been receiving requests for the notarization and apostille follow up of various Special Power of Attorneys (SPAs) needed in the Philippines.
Some of the SPAs I’ve notarized and followed up for apostille at the Secretary of State, Notary Public Section in Sacramento, California included the following:
1. SPA to transact and follow up the completion of the DEED OF SELF-ADJUDICATION WITH DEED OF DONATION. To transact with the Bureau of Internal Revenue (BIR), Register of Deeds, Office of the Municipal Assessor, Land Tax Division and other government agencies or offices concerned;
2. SPA to sell the parcels of land in San Narciso, Zambales, Philippines. To execute and sign in their names an Extra Judicial Settlement with Sale or other Deed of Conveyance that maybe required. To get/receive proceeds of the sale. To execute and sign documents and papers relative to the foregoing authority;
3. SPA to manage and check PNB (Philippine National Bank) account. To deposit and withdraw money from PNB account. To do and perform all acts necessary to accomplish the foregoing transactions;
4. SPA to negotiate and sell property located in Trece Martires, Cavite, Philippines. To receive any and all payments due from the sale of the property. To cause the payment with the BIR (Bureau of Internal Revenue) for taxes and local fees and the filing of the corresponding returns and securing the necessary certifications, clearances and/or documents in connection with the sale, transfer, or conveyance of property before various government agencies, including, but not limited to the BIR, the Office of the City/Municipal Assessor and the Registry of Deeds. To do and perform every act and thing requisite, necessary and proper to carry out the above purpose;
5. SPA to apply for Tax Identification Number (TIN) for verification. To apply and transact with the Bureau of Internal Revenue (BIR) for capital gains tax and documentary tax computation of property with Bacoor City Treasurer and Assessor. To perform all acts or things which maybe required or necessary to accomplish the aforementioned transactions.
6. SPA to coordinate, transact with the buyer, sell the property located in Amian, Negros Oriental, Philippines. To receive proceeds of the payment from the sale of the above-mentioned property;
7. SPA to administer and manage property located in Paranaque City, Philippines. To pay property taxes, utility bills like water and electric. To execute and sign documents and necessary papers to accomplish the above-mentioned transactions;
8. SPA to deposit and withdraw money in BPI Savings Account located at BPI Branch in Commonwealth Avenue, Quezon City, Philippines. SPA for surrendering matured Life Insurance Certificate and Withdrawal of Face Value. SPA for leasing of Residential House & Lot located in Fairview, Quezon City, Philippines;
9. SPA prepared by lawyer for the execution of the Extra-Judicial Settlement of Estate with the Registry of Deeds, Zambales, Philippines.
The above-mentioned SPAs were notarized and submitted for apostille to the Secretary of State, Notary Public Section in Sacramento, California and made the documents legal and binding in the Philippines. Here’s excerpts of the Special Notice from the Legal Section, Philippine Consulate Office in San Francisco, California on the Accession of the Philippines to the Apostille Convention:
“Please note that Apostilled document/s no longer need additional authentication by the Philippine Consulate General. Once apostilled, it already has legal validity and can be sent to the Philippines for use.”
